On Thursday, December 12, 2024, John David Martinez, 28, was sentenced to 38 years in prison by a Victoria òòò½ÊÓƵ jury for the first-degree felony offense of continuous sexual abuse of a child under the age of 14, following an investigation by the Victoria Police Department.
On April 17, 2024, the child victimòòò½ÊÓƵ™s grandmother called 911 to report that her 10-year-old grandchild made an outcry of sexual abuse occurring throughout the previous year. The child testified at trial.
In addition, Martinez was found guilty of two counts of possession of child pornography for images located on his cellular phone during the investigation. Martinez will not be eligible for parole. A conviction for continuous sexual abuse of a child must be served day for day, thus the defendant will be 66 years of age at the time of his release.
Victoria Police Department Detective Christina Tate led the investigation, with digital forensic assistance by Detective Aaron Smalley. First Assistant District Attorney Jordan Fries prosecuted the case with the support of Assistant District Attorney Andrea Harvey. The defendant was represented by Brian Watson and Marvin Faires of the Crossroads Regional Public Defenders Office. Judge Elà Garza presided over the four-day trial.
